Grupos de pessoas com interesses sujos estão tentando fazer a Ficha Limpa ser rejeitada pelo Supremo Tribunal Federal utilizando fracas alegações. Mas um crescente coro de juristas está lutando contra isso. Se nós apoiarmos agora a mensagem deles, nós poderemos convencer o STF a nos proteger dos criminosos no poder. É ultrajante - depois de nossa vitória histórica contra a corrupção, grupos de pessoas com interesses sujos estão tentando fazer a Ficha Limpa ser rejeitada pelo Supremo Tribunal. Mas essa fraca reividicação pode ser abafada pelo nosso apelo de apoio.
Os opositores argumentam que os candidatos que já tenham sido condenados por um juiz e, em seguida, por um tribunal, não devem ser impedido de candidatar-se, caso eles queiram desesperadamente recorrer a um tribunal superior. É um argumento ilegítimo. Entretanto, lobbys poderosos estão pressionando duramente para tentar desfazer a mais forte legislação anti-corrupção que o Brasil já teve. Agora, um coro crescente de especialistas jurídicos está lutando fortemente argumentando que a Ficha Limpa é perfeitamente constitucional.
O Supremo Tribunal Federal está dividido e vai votar a constitucionalidade da lei dentro de 36 horas. Se enfatizarmos a mensagem dos juristas, mostrando um apoio maciço a lei que lutamos muito para conquistar - poderemos convencer os juízes do STF a nos proteger dos criminosos no poder. A presunção de inocência significa que nenhuma pessoa pode ser considerada como culpada até que se prove o contrário e o direito penal do Brasil toma todo o cuidado de preservar esse direito. Mas os adversários da Ficha Limpa estão usando isto para argumentar ridiculamente que as pessoas que foram condenadas por um crime grave por um conjunto de juízes, não podem ser impedidas de concorrer a cargos políticos.
Isso significa efetivamente que criminosos condenados poderão concorrer a um cargo durante o longo processo de recurso legal que pode durar anos e tornaria assim ineficaz a lei da Ficha Limpa, permitindo que políticos ricos comprem seu direito de entrar com um recurso atrás do outro , permanecendo no cargo enquanto os processos são analisados.
Felizmente, um time dos sonhos de juristas se uniu para se opor a estes truques sujos e vão apresentar hoje a base legal que mostra que na lei eleitoral é perfeitamente legal tratar alguém como inelegível depois de condenação confirmada por um tribunal. Vamos todos apoiar este grande desafio legal contra aqueles que querem enterrar a Ficha Limpa e mostrar ao STF que os brasileiros não vão mais esperar para ter nossa duramente conquistada legislação anti-corrupção.
